Q= What is "Overtime Rate of Pay?”
A= “Overtime Rate of Pay" is the rate at which an employer should pay his employee for the hours the employee worked over 8 hours a day or 40 hours a week. Hours in excess of 8 hours per day or 40 hours per week are required to be paid at the rate of one and a half times the base rate of pay. If an employee works 12 hours or more a day, the employer is required to pay at twice the base rate for the hours in excess of 12. Also, if an employee works without a day off on a 7-day work schedule, the employer must pay at one and a half times the base rate for the first 8 hours of the 7th day and at twice the base rate for hours worked in excess of 8 on the 7th day. Refer to the following tables for overtime pay calculation examples.

Tables 1 and 2 are examples of an employee’s working hours that are not subject to overtime rate of pay, whereas Table 3 is an example of an employee’s schedule that qualifies for overtime rate of pay. According to Table 3, the employee had overtime of 4 and 5 hours on Tuesday and Wednesday, respectively. The first 4 overtime hours each day are subject to a rate of one and a half times the base rate of pay. Hours in excess of the first 4 accrued overtime hours are subject to twice the base rate of pay. Hence for Wednesday, the employee must be paid at twice the base rate of pay for the 13th hour he or she worked.
Besides 9 combined overtime hours from Tuesday and Wednesday, the employee accrued 42 hours in a working week according to the table. The first 40 hours are paid at a regular rate; however, the last two hours must be paid at a rate of one and a half times the base rate. In total, as shown in Table 4, the employee had 10 hours subject to a rate of one and a half times the base rate and 1 hour subject to a rate of twice the base rate.

첫번째와 두번째 표를 보시면 약간의 차이가 있지만 둘다 Overtime이 성립되지 않습니다. 세번째 표와 같은 경우에는 오버타임이 성립됩니다. 세번째 표를 보시면 화요일과 수요일 각각 네시간과 다섯시간씩 오버타임을 했습니다. 총 근무한 시간중 처음 여덟시간을 제한 나머지 시간중 처음 네시간씩은 기본임금의 1.5배를 지급받아야 합니다. 또한 수요일에 근무한 열세시간중 마지막 한시간은 두배보상이 적용되어야 합니다.
표에서 보시는바와 같이 화요일과 수요일에 근무한 아홉시간의 오버타임을 제할 시 총 마흔두시간을 근무하였습니다. 마흔두시간중 처음 마흔시간은 표준임금률에 따른 임금이 계산되지만 마지막 두시간은 오버타임이 적용되어 1.5배의 지급률에 따라 임금이 적용됩니다. 네번째표에 나타나 있듯이 오버타임의 적용을 받는 시간은 총 쉰한시간의 근무시간중 1.5배의 지급을 받는 열시간과 두배의 지급을 받는 한시간입니다.
