국익 기여자 취업 이민 2순위 (National Interest Waiver, NIW), 스포츠 선수는 가능한가?
안녕하세요, 송동호 종합로펌 이민팀입니다. 고학력자 독립이민으로 많이 알려져 있는 취업 이민 2순위인 국익기여자 취업이민(National Interest Waiver, NIW)은 미국 고용주의 취업 제안(Job Offer), 노동인증(PERM), 노동허가서(LC)가 없어도 영주권을 신청할 수 있는 취업 영주권 제도입니다. 취업이민에 있어 가장 민감한 부분들이 제외되기 때문에 많은 분들의 관심을 받아왔습니다. 최근 트럼프 행정부 하에서 가족이민, 취업이민이 점점 더 힘들어지고 H-1B와 같은 취업 비자의 축소가 예상되자 NIW에 대한 관심은 더욱 높아지고 있습니다.
지난 수년간 이 제도의 혜택을 받은 사람들이 과학 분야에서 박사 이상의 학력을 가진 박사후과정(Post Doctor)을 밟고 있는 지원자라든지 혹은 교수들이었기 때문에 마치 NIW가 과학분야의 고학력자들을 위한 과정처럼 보였던 것 같습니다. 하지만, 사실상 NIW는 분야의 제한이 없어 “미국의 국익에 기여할 수 있다”는 조건만 충족한다면 가능합니다. 예를 들어, 스포츠 분야도 그 예가 될 수 있습니다.
저희 로펌에서 진행했던 다수의 NIW케이스들은 운동선수들이었습니다. 한국에서 축구 선수로 활약했던 A고객의 예를 생각해 볼 수 있습니다. A 고객은 한국의 지방팀에서 인기 있었던 축구선수였습니다. 하지만, 모든 활동이 국내 대회에 국한되어 있었고 월드컵이나 올림픽 국가대표에는 포함된 적이 없었습니다. 은퇴 후 A고객은 청소년 축구팀의 코치로 활약하면서 규모가 작은 국제대회에서 우승을 하는 기록을 내기도 하였습니다. 이 고객의 NIW 케이스 의뢰를 받고 저희 변호사들은 미국의 축구 시장을 분석하였고 재미있는 사실을 알게 되었습니다. 미국의 유소년 축구의 경우 농구나 미식축구 못지 않게 인기가 있으나 이 유소년 축구가 성인 축구로 연결되지 않는다는 점입니다. 미국 축구 전문가들은 유소년 축구에서 재능을 보이면 유럽으로 가서 추가적인 훈련을 받지 미국에서 계속하지 않는다는 문제를 지적하면서 미국에 유능한 코치들이 필요하다는 내용의 컬럼을 다수 발견하였습니다. 또한, 미국의 FIFA 순위가 지난 수년간 제자리 걸음이거나 떨어지고 있다는 점도 확인할 수 있었습니다. 저희는 이러한 리서치를 근거로 축구라는 운동 종목의 장점, 미국 축구 시장의 잠재력, 현재의 코치 부족으로 인한 문제점을 분석하고 A고객이 미국에 와서 활동하는 경우 국익에 도움이 될 것이라는 내용을 제출하여 즉각 승인을 받았습니다. 이는 고학력자 과학자 이외의 분야 종사자도 NIW가 가능하며 반드시 월드컵과 같은 국제 대회에 참가한 경력이 없어도 승인이 가능하다는 예시가 될 수 있습니다.
또한, 다른 운동선수의 경우 미국 소수자라는 것에 초점을 맞춰 승인을 받기도 하였습니다. 대부분의 운동 종목이 타고난 체격에 영향을 받는 것이 사실입니다. 따라서 바디빌딩과 같은 육체미를 강조하는 국제대회에서는 특히 동양인이 우승을 한다는 것은 쉬운 일이 아닙니다. 저희는 바디빌딩을 하는 고객 B의 NIW케이스를 맡으면서 바디빌딩에 대한 시장 분석을 하였습니다. 지난 수십년간 대부분의 국제대회 수상자는 백인 혹은 흑인이었고 동양인은 거의 찾아볼 수 없었습니다. 저희 고객은 대규모 국제대회에서 우승한 적은 없지만 아시아권에서 수차례 우승을 한 선수였습니다. 저희는 미국의 인종 다양화, 백인과 흑인이 우월하다고 믿어지는 바디빌딩 미국 시장에서 이 고객이 열정적으로 참여한다면 미국 내 다른 인종들에게 큰 힘이 될 것이라는 점을 강조하였습니다. 이 청원서에 저희는 인종적으로 불리하다고 여겨졌던 다양한 분야에 선구자적인 사람들이 어떻게 활약하고 인종의 벽을 깼는지를 언급하였습니다. 이 케이스도 즉각 승인되었습니다.
스포츠 분야는 과학 분야 못지 않게 NIW의 혜택을 많이 받을 수 있는 분야입니다. 더구나 일반 취업 영주권에 반드시 필요한 미국 고용주의 취업 제안(Job Offer)을 스포츠 분야 종사자가 받기는 쉽지 않습니다. 따라서, 스포츠 분야 종사자로 국제대회, 혹은 굳이 국제대회가 아니더라도 어느 정도 인정받는 대회에서 수상한 경력이 있다면 반드시 NIW를 고려해보시기 바랍니다.

Can Sports Athletes Apply for the National Interest Waiver?
A National Interest Waiver (NIW) falls in the employment-based, second-preference (EB-2) immigration category. Generally, EB-2 petitions require a full-time job offer and an approved labor certification (so-called “LC”) from a U.S. employer. However, these requirements are waived for the NIW, thus allowing a petitioner/applicant to apply for a green card without a job offer or an approved labor certification from a U.S. employer. For the reasons, the NIW has received much attention from numerous foreigners who seek for permanent resident status in the U.S.
Over the past several years, a general misperception has developed about the NIW: many seem to think that it is only for people holding an advanced degree in a science-related field. It is true that the NIW is popular among people with at least a doctoral degree or professors in a science-related field. However, the NIW is not limited in scope and the only essential requirement of the NIW is to be able to contribute to the national interest of the U.S. For instance, sports athletes can also apply for the NIW.
Many of our firm’s NIW cases are on behalf of athletes. For example, one client was a football player in Korea. This client was a very popular football player in Korea’s local league. However, all his sporting activities were limited to local competitions and never at the World Cup or Olympic Games level. After his retirement, the client was a coach for a youth football team, and his team recorded a win at a small international competition. Upon retaining the client’s NIW case, our attorneys analyzed the American football market and discovered a very interesting fact. Youth football in the U.S. was just as popular as basketball or American football, and interestingly, this popular youth football was not at all connected to adult football. We found many articles and columns stating that talented youths usually ended up in Europe to pursue further training and that America was in dire need of more football coaches. We were also able to confirm that the FIFA rankings of the U.S. had remained unchanged for many years. Based on this research, we analyzed the advantages of football, the potential of the U.S. football market, and the problems associated with the current shortage of coaches. Upon submitting the petition based on this research showing that the client would benefit the national interest should he be able to come to the U.S., the petition was approved. This is an example of a case where an NIW based on a field other than a science field can be approved, even without necessarily having international level experience such as the World Cup.
In addition, other types of athletes have been approved based on being part of a group that is much needed in the U.S. It is true that many sports are influenced by natural genetic factors in terms of strength and physique. As such, it may not be easy for Asians to win international competitions that are based on physique and strength such as bodybuilding. Another client we represented was a bodybuilder, and we analyzed the bodybuilding market. In the past several decades, most international competition winners were white or black, with very few winners being Asian. Our client had never won a major international competition, although he had won many competitions in Asia. We emphasized in his petition that if this person were to be actively involved in the U.S. competition scene, the American bodybuilding market, which to date was believed to be predominately white or black, would greatly benefit by being able to inspire and attract other races to the U.S. bodybuilding scene. We mentioned in the petition that pioneering people in various fields who were considered to be racially underrepresented were the ones who could help break down racial barriers. This case was also immediately approved.
The field of sports, just like the science field, is a field that can benefit from the NIW as well. Furthermore, it is not easy for an athlete to receive a job offer from a U.S. employer, which is required for a regular employment-based green card petition. As such, whether you are an international athlete or even a local athlete who has gained sufficient local recognition, the NIW is a viable option that should definitely be considered.
运动员能够申请NIW吗
国家利益豁免移民（National Interest Waiver，简称NIW）是美国移民法职业移民第二优先 （Second Preference Employment Based Immigration，简称EB-2）的一个特例。通常申请人走EB2途径申请绿卡，需要由雇主为其提交EB2申请，并申请劳工证（Labor Certification，简称LC）。符合NIW的申请人不需要美国雇主，不需要满足工资要求（Prevailing Wage），不需要由其雇主为其向劳工部（Department of Labor， 简称DOL）申请劳工证，便可以直接向移民局提出第二优先移民申请（EB-2 I-140）。也正因为此，许多外籍人士都选择NIW进行绿卡申请。
关于NIW大家有一个非常常见的误区 – 只有在科学领域有硕士及以上学位的人才有资格进行NIW的申请。的确，在科学领域有硕士或博士学位的申请人通常会选择NIW进行绿卡申请。但是，NIW并非仅限于科学领域的申请人，准确地来说，申请NIW唯一的标准就是申请人的工作是否有利于美国国家利益。因此，只要满足这一标准，运动员也可以提出NIW的申请。
我们律所帮助许多运动员成功获得了NIW的批准。我们有一位客户是一位在韩国小有名气的足球运动员。但是，他所有的参赛经历都仅限于韩国国内的地方性赛事，从来没有参与过世界杯或奥林匹克等国际性赛事。退休以后，他成为了一支少年足球队的教练。拿到这个案子之后，我们的律师对美国的足球市场做了研究分析，发现了一件非常有趣的事情：青少年运动中，足球和篮球、橄榄球一样热门，但是，青少年足球和竞技足球在美国完全没有衔接。我们发现很多文章报道了大部分优秀的美国青少年足球球员都需要去欧洲接受更全面的足球深造。而在另一方面，美国又急需优秀的足球运动员。另外，我们还发现美国在FIFA国际足联上的排名已经多年没有变化了。根据研究结果，我们进一步分析了足球的优势、美国潜在的足球市场以及目前所面临的找不到足球教练的窘境。根据这些材料，我们向移民局证明了这一客户能够给美国国家利益带来有利的影响。即便没有国际级比赛的经历，科学领域之外的申请人也有可能获得NIW的批准。
除却足球运动员之外，其他运动员也能够提交NIW申请。我们都知道，可以说能否成为运动员很多时候取决于先天的身体条件，尤其是一些对身体素质要求比较高的运动。因此，在一些对于身体要求很高的运动赛事中，比如健美，我们相对会比较难看到亚洲人的面孔。我们的这位客户是一位来自亚洲的健美选手，虽然他在亚洲的比赛中屡屡获奖，但是从来没有在国际级的赛事中获得过名次。我们都知道在国际级的健美赛事中，大部分的获奖者都是白人或者黑人，只有极少数是亚洲人。美国的健身市场也是一样，大部分的健身教练都是白人或者黑人。因此，在我们的申请中，我们向移民局强调如果移民局批准了我们客户的申请，亚裔健身教练能够促进亚裔参与到健身活动中来。根据以往的经验，在行业内鼓励参与人数较少的族裔能够帮助打破种族界限。这个案子也很快就得到了批准。
运动领域的申请人，就像科学领域的申请人一样，可以尝试通过NIW申请绿卡。另外，因为运动领域的申请人很难找到雇主为其递交绿卡申请，不需要雇主的NIW绿卡申请可以为其提供一条捷径。因此，如果你是一名在国际上享有盛誉或在地方性比赛中屡次获奖的运动员，不妨考虑一下NIW。
