안녕하세요, 송동호 종합로펌 이민팀입니다. 취업 이민 2순위인 국익기여자 취업이민(National Interest Waiver, NIW)는 미국 고용주의 취업 제안(Job Offer), 노동인증(PERM), 노동허가서(LC)가 없어도 영주권을 신청할 수 있는 취업 영주권 제도입니다. 취업이민에 있어 가장 민감한 부분들이 제외되기 때문에 많은 분들의 관심을 받아왔습니다. 최근 트럼프 행정부 하에서 가족이민, 취업이민이 점점 더 힘들어지고 H-1B와 같은 취업 비자의 축소가 예상되자 NIW에 대한 관심은 더욱 높아지고 있습니다.
지난 수년간 이 제도의 혜택을 받은 사람들이 과학 분야에서 박사 이상의 학력을 가진 박사후과정(Post Doctor)을 밟고 있는 지원자라든지 혹은 교수들이었기 때문에 마치 NIW가 과학분야의 고학력자들을 위한 과정처럼 보였던 것 같습니다. 하지만, 사실상 NIW는 분야의 제한이 없어 “미국의 국익에 기여할 수 있다”는 조건만 충족한다면 가능합니다. 예를 들어, 마케팅, 비즈니스 분야도 그 예가 될 수 있습니다.
저희 로펌에서 진행했던 다수의 NIW 케이스 중 마케팅과 비즈니스 분야는 논문의 인용수나 학회 초대등을 강조하는 과학 분야와는 많이 다릅니다. 고객 A씨는 디자인 관련 학과 재학 중 근처의 애완견 놀이터나 애완견 관련 가게들, 애완견이 산책하기 좋은 길을 확인할 수 있는 스마트폰 어플리케이션을 개발하였습니다. 이 어플리케이션은 애완견을 키우는 사람들이 많지만 인구 밀집도가 높아 애완견 산책이 쉽지 않은 미국 대도시에서 활용도가 매우 높았고 실제로 많은 인기를 끌기 시작하였습니다. 연이어 고객 A씨는 다른 몇 개의 어플리케이션을 개발하였는데 모두 공공의 이익에 도움이 되는 것들이었습니다. 고객 A씨의 어플리케이션은 공공의 이익에 초점을 맞추고 있었기 때문에 많은 수익이 나지는 않았지만 저희는 사회 기여 측면과 A씨는 계속하여 이 분야에 종사하면서 미국의 이익 증대에 기여할 것이라는 내용으로 NIW 청원서를 제출하였고 이 케이스는 즉각 승인이 되었습니다.
고객 B씨는 스타트업 창업자였습니다. 올해 7월에 시작되는 벤처사업가들을 위한 체류 허가 제도를 들어 알고는 있었지만 그 때까지 기다리기 싫었고 또한 영주권이 아닌 체류 허가는 역시 일시적일 수 있다는 생각에 NIW를 시도하기로 하였습니다. 스타트업 창업의 경우 이미 여러차례 미국 고용주로부터 취업 제안이나 노동인증요구가 불필요하고 요구하는 것 자체가 문제 소지가 있다는 점을 이민 변호사들이나 이민 정책 관련자들이 수차례 지적을 해 왔습니다. 저희는 B씨가 이미 상당한 투자를 약속 받았으며 이 스타트업 사업이 성공할 가능성이 매우 높다는 점을 들어 NIW 청원서를 제출하였습니다. 이 케이스도 크게 문제 없이 승인되었습니다.
흔히 NIW는 과학 분야 종사자들을 위한 이민정책으로 이해하시는 분들이 많습니다. 그리고 실제적으로 NIW의 대부분의 승인 케이스는 과학 분야 종사자들에 대한 것입니다. 하지만, 이민법에서 NIW는 과학 분야에 한정되어 있지 않으며 미국 국익에 도움이 되는 모든 분야를 포괄하고 있다고 분명 나와있습니다. 만약, 자신이 마케팅 혹은 경영 분야에서 두각을 나타내고 있다면 NIW를 반드시 고려해보시기 바랍니다.

National Interest Waiver (NIW), Possible for Professionals in Marketing and Business?
A National Interest Waiver (NIW) falls in the employment-based, second-preference (EB-2) immigration category. Generally, EB-2 petitions require a full-time job offer and an approved labor certification (so-called “LC”) from a U.S. employer. However, these requirements are waived for the NIW, thus allowing a petitioner/applicant to apply for a green card without a job offer or an approved labor certification from a U.S. employer. For the reasons, the NIW has received much attention from numerous foreigners who seek for permanent resident status in the U.S.
Over the past several years, a general misperception has developed about the NIW: many seem to think that it is only for people holding an advanced degree in a science-related field. It is true that the NIW is popular among people with at least a doctoral degree or professors in a science-related field. However, the NIW is not limited in scope and the only essential requirement of the NIW is to be able to contribute to the national interest of the U.S. For instance, people from marketing and business related fields can also apply for the NIW.
Among the many NIW cases we have handled at our firm, cases related to a marketing or business field are handled quite differently from cases related to a science field that place special emphasis on the number of citations and/or invitations to prestigious conferences. Instead, we focus on the overall effect on the public interest. For instance, a client developed a smartphone application that can check for nearby dog playgrounds, dog-related stores, and dog walking routes. The application soon became very popular in the big cities where many people have dogs but the population density is so high that it is not easy to find suitable dog walking routes. The client subsequently developed several other applications, all of which had a beneficial effect on the public interest. As the client’s applications focused primarily on the public interest, the profit level was not so high. Regardless, we filed a NIW petition on the basis this client has contributed to the communities in the U.S. and would continue to work to make a social contribution to the society at large by developing various applications. This case was approved without any issues.
There are many people who perceive the NIW as an immigration petition for those only working in a science related field. In reality, it is true that most of the approved cases for the NIW are indeed related to a science field. However, in accordance with immigration law, the NIW is not limited to only science related fields. Rather, the NIW is open to any field that is considered to be beneficial to the national interest of the U.S. As such, if you are a leading figure in the fields of marketing or business, you should definitely consider the NIW as a viable immigration option.

企业家和市场营销人员也能申请NIW?
国家利益豁免移民（National Interest Waiver，简称NIW）是美国移民法职业移民第二优先 （Second Preference Employment Based Immigration，简称EB-2）的一个特例。通常申请人走EB2途径申请绿卡，需要由雇主为其提交EB2申请，并申请劳工证（Labor Certification，简称LC）。符合NIW的申请人不需要美国雇主，不需要满足工资要求（Prevailing Wage），不需要由其雇主为其向劳工部（Department of Labor， 简称DOL）申请劳工证，便可以直接向移民局提出第二优先移民申请（EB-2 I-140）。也正因为此，许多外籍人士都选择NIW进行绿卡申请。
关于NIW大家有一个非常常见的误区 – 只有在科学领域有硕士及以上学位的人才有资格进行NIW的申请。的确，在科学领域有硕士或博士学位的申请人通常会选择NIW进行绿卡申请。但是，NIW并非仅限于科学领域的申请人，准确地来说，申请NIW唯一的标准就是申请人的工作是否有利于美国国家利益。因此，只要满足这一标准，企业家和市场营销人员也可以提出NIW的申请。
我们办理过许多的NIW案件，科学类申请人的案件和商务类申请人的案件的处理方法是很不一样的。科学类的案件，移民官主要看发表的文章被引用数以及被邀请参加重大会议的次数。而对于商务类申请人的案件，移民官则会综合考虑申请人对国家利益的影响。比如， 我们有一位客人制作了一个能够帮助用户发现附件宠物狗公园、宠物店、适合遛狗的路线的手机应用软件。很快地，在人口密集、宠物狗盛行的大城市里，这款应用迅速被传播开来并广受好评。我们客人又相继研发了多款类似的有利于社会公共利益的手机应用。但是，因为他的研发方向主要专注在社会公共利益领域，他的研发成果的商业利润并不是那么的高。在他的材料中，我们向移民局据理力争，详细叙述了他所研发的应用对美国公共利益所有的积极的影响。最终，这个案子顺利得到了批准。
很多人误以为只有科学领域的申请人才能够申请NIW。虽然大部分的被批准的NIW的案子都是与科学领域相关的，但是，像我们之前所提到的，NIW并不仅限于科学领域的申请人 – 任何能够证明其有利于美国国家利益的申请人都可以申请NIW。
